www.rentalneed.com provides as a service to enable its users to connect with one another. Jaipur Rental provides the platform but does not directly participate in, nor is it involved in any transactions. Please keep in mind that listings/advertisements are posted not by Jaipur Rental, but Users of Jaipur Rental. Users of this service are responsible for all aspects of the transactions in which they choose to participate. Jaipur Rental requires a User to register before posting a listing/classifieds advertisements but does not screen or control Users who may rent out or take the rental through the Web Site, nor does Jaipur Rental review or authenticate all listings, items, or services offered for rent. Jaipur Rental has no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of Rentors to rent items or the ability of Rentees to take the items on rent.

Therefore, users of this service should be aware that:

• Rentee and Rentor are completely responsible for working out the rent. They must resolve any disputes that may arise in their dealings.
• Rentee and Rentor are responsible for all applicable taxes and for all costs incurred by participating in Jaipur Rental.
• Jaipur Rental will not be liable for any damages of any kind incurred as a result of the information contained in the website www.rentalneed.com.
• Jaipur Rental does not make any representation or warranty as to the attributes (such as legal title, creditworthiness, identity, etc.) of any of its Users. You are advised to independently verify the bona fides of any particular User that you choose to deal with on the Site and use your best judgment in that behalf.
• The Users shall independently agree upon the manner and terms and conditions of delivery, payment, insurance etc. with the other registered Users that you transact with.

This Site is only a venue where Users may meet and interact with one another for their transactions. Jaipur Rental is not and cannot be a party to or control in any manner any transaction between two Users of the Site.

OBLIGATIONS OF USER

The accuracy of the Registration Data given to the Jaipur Rental on initial application for the registration shall be the sole responsibility of the User.

Any licenses, permits, consents, approvals and intellectual property or other rights as may be required for using the Service shall be obtained by the User at his own cost.

The User will ensure compliance with all notices or instructions given by the Jaipur Rental from time to time to enable the use of the Service.

The User understands and agrees that User is responsible for all applicable taxes and for all costs that are incurred in using the Jaipur Rental service.

The User shall be solely responsible for all information retrieved, stored and transmitted through the Service by him.

The User shall immediately notify the Jaipur Rental of any un-authorized use of the User’s account or any other breach of security known to the User.

The User shall promptly make the payment to the Jaipur Rental towards the Listing Fees as and when it becomes payable.

The User shall be responsible for the set-up or configuration of his equipment for access to the Service.

Jaipur Rental in its sole discretion shall reserve the right to edit, modify and alter the content. User agrees that the online advertisements/ listings placed with Jaipur Rental shall be reflected after 48 hours. It is to be noted that there can be likely delay in posting of listing which would be subject to realisation of payment and listing contents. The User further agrees to the stipulated 48 hours processing and the delay as mentioned herein above.

The User will indemnify Jaipur Rental for any action or claim committed/made by any third party resulting from any information posted on the site by the user or/and anybody else on his behalf.

PROHIBITED ACTIONS

• User is restrained from allowing any person other than the authorized person(s) named in the application form to use the Service.
• The User undertakes not to resell or assign his/her rights or obligations under these Terms & Conditions. User also agrees not to make any unauthorized commercial use of the Service.
• The User shall use the Service only for the purpose for which it is subscribed.

The User shall not to print, download, duplicate or otherwise copy, delete, vary or amend or use any data or personal information for any process other than renting the prescribed service posted by any User on Jaipur Rental except such data and information which is posted by the particular User himself.

• The User shall not share the Service with any person without the prior written approval of the Company.
• The User shall not use the Service for any unlawful purpose including without limitation criminal purposes
• The Service shall not be used to send or receive any message, which is offensive on moral, religious, racial or political grounds or of an abusive, indecent, obscene, defamatory or menacing nature.
• The User shall be prohibited if they persistently send messages or make postings on Jaipur Rental to any other User or third party who access Jaipur Rental without reasonable cause or for causing any threat or/and harassment or/and annoyance or/and anxiety or/and any other inconvenience whatsoever caused to any person.
• The User shall not infringe on any intellectual property rights of any person or/and retain information in any computer system or otherwise with an intention to do so.
• User agrees not to make use of anyone else's Information other than as necessary to complete any Jaipur Rental transactions in which you are involved.
• The User shall be prohibited to introduce, post or transmit any information or software, which contains a virus, worm or other harmful component into the internet or Jaipur Rental network system.
• The Jaipur Rental strongly opposes SPAM, which floods the Internet with unwanted and unsolicited email and deteriorates the performance and availability of the Jaipur Rental service. All forms of SPAM, or any other activities that have the effect of facilitating SPAM, are strictly prohibited. Jaipur Rental also prohibits the use of another Internet service to send or post SPAM to drive visitors to your site hosted on or through Jaipur Rental systems, whether or not the messages were originated by you, under your direction, or by or under the direction of a related or unrelated third party.
• Users shall not use or manipulate this service for any fraudulent activity or purpose. Items or services offered for rent must comply with applicable laws
• Users may not post the same ad in multiple places. Jaipur Rental may take action to delete the classifieds ads and/or Jaipur Rental user accounts that we believe are misusing this service. Prohibited spam or otherwise impermissible marketing activities in Jaipur Rental may include, but are not limited to, the following:
  • Posting an ad that is unrelated to the category in which the ad is placed.
  • Posting identical ads in the same category and location.
  • Posting an ad with inappropriate links, titles, descriptions, or unauthorized use of content to which the person posting does not have rights.
  • Posting an ad through unauthorized robots (crawling software).
  • Posting an ad that is unrelated to the category in which the ad is placed.
  • Soliciting a Jaipur Rental Classifieds user to post an ad in another classifieds site.
  • Posting ads for services that compete with any of Jaipur Rental 's services.

Your Information

Your information shall not link directly or indirectly to or include descriptions of items, goods or services that:

• are prohibited under the User Agreement or any other applicable law for the time being in force including but not limited to the Drugs and Cosmetics Act, 1940, the Drugs And Magic Remedies (Objectionable Advertisements) Act, 1954, the Indian Penal Code, 1860
• are identical to other items you have up for listing but are priced lower than your item's price, the reserve price of the item or minimum bid amount;
• are concurrently listed for rent on a web site other than the Site; or
• You do not have a right to link to or include.
  1. Solely to enable Jaipur Rental to use the information you supply us with, so that we are not violating any rights you might have in Your Information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in Your Information, in any media now known or not currently known, with respect to Your Information. Jaipur Rental will only use Your Information in accordance with the User Agreement and Jaipur Rental’s Privacy policy.
  2. You represent and confirm that you shall be the sole and exclusive legal owner of all items, goods or products of any description that you wish to offer for rent on the Site. You shall have complete right, title and authority to deal in and offer for rent such items, goods or products.
  3. In the event that any transaction or attempted transaction relating to any item, good or service which is violative of this User Agreement or applicable law comes to your knowledge, you shall take all steps to inform Jaipur Rental of the same. You may contact Jaipur Rental at You shall not, either alone or in conjunction with other Users, manipulate or attempt to manipulate the prices of any item or services being rented on the Site.
  4. You shall comply with all applicable Domestic (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/ VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding your use of our service and agreeing to rent the listing, items or services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force. In particular you shall ensure that if any of your items listed on the Site qualifies as an "Antiquity" or "Art treasure" as defined in the Act ("Artwork"), you shall indicate that such Artwork is "non-exportable" and shall ensure that it is not delivered to any Rentee at any place outside India.
  5. From time to time, you shall be responsible for providing information relating to the items or services proposed to be sold by you. In this connection, you undertake that all such information shall be accurate in all respects. You shall not exaggerate or over emphasize the attributes of such items or services so as to mislead other Users in any manner.
  6. You will not disclose your contact details like Phone number, address, emailing address in bidding, buying or listing process, or anywhere on the Site including the feedback area, discussion forum or through any e-mail feature to bypass Jaipur Rental.

Administration Of Listings

Any User agrees not to submit any property descriptions, photographs, financial, contact or other information contained in each property's or other rental service data to Jaipur Rental unless the user has acquired and received all necessary rights and authorizations from the owner of such property or other rental service or the power of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the said Property(s) or other rental service on the Jaipur Rental 's website. The user shall disclose all material information in respect of all such property(s) or other rental service submitted including the present status and nature of such property or other rental service and shall also disclose whether the property or other rental service is free from all encumbrances or not. The user in addition shall furnish a brief background of such property or other service in respect of title, ownership and possession, Jaipur Rental may also require the user to support his/her claims with respect to the status of the property or other rental service with such documents as may be specified by it from time to time. The user may further be required to substantiate his claims as to the nature and status of the property or other rental service by swearing an affidavit stating the authenticity of the information/data so provided/displayed. Jaipur Rental may, at its sole discretion but without any obligation to, search for such and remove properties that are alleged to have been submitted in violation of this provision. In addition, Jaipur Rental may require additional evidence of compliance with this provision from users who are alleged to have submitted Properties or other information/data in violation of this Agreement. Jaipur Rental will, in its sole discretion, terminate the accounts of, and refuse service to, any user who repeatedly or intentionally violates this Agreement. Additionally, the user agrees to allow the Property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the Jaipur Rental 's website. Jaipur Rental shall have the sole authority to choose the manner in which any Property will be searched, displayed, accessed, downloaded, copied, and otherwise used on Jaipur Rental and Jaipur Rental shall have the right to modify the property listing in the exercise of its rights under this Agreement. In addition to the terms aforementioned the User agrees

• (a) to represent and warrant that all properties or other service and associated information provided by the user will be accurate;
• (b) that the user will not permit the posting of a property or other rental service on Jaipur Rental under a name other than the name of a real estate agent who has been duly authorized and engaged by the owner of the property in this regard;

Jaipur Rental reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the properties or other service posted on the Jaipur Rental 's website without notice. Jaipur Rental accepts no responsibility for checking/verifying the accuracy of reports or data files submitted by the user. While Jaipur Rental shall take all reasonable efforts for data backup and business resumption, the user will be solely responsible for retaining back-up copies of all information, photographs and other materials furnished/submitted to Jaipur Rental.

Users, who are renting property/services through Jaipur Rental, must verify details the property/services as well as its right, title, ownership, lien etc. on their own.

In case of property rented from an duly licensed agent/broker who is also registered with Jaipur Rental the Rentee is required to pay service charges to the agent mutually agreed between the Rentee and the agent. Jaipur Rental has no control over the charges charged directly to Rentee by the agent/broker. Also Jaipur Rental has no liability over the charges and service tax for the charges charged in this transaction. If registering as individual, user cannot charge any brokerage.

Listing Fees

Membership on the Site is free. But for certain services you will be charged listing fees. The fees are mentioned as per the service .Jaipur Rental does not charge any fee for browsing. Jaipur Rental charges Special Listing Fees are charged to listers who use the Listing Feature for listing their properties/services.
The Fee Charging and Credit policies on Jaipur Rental are effective from October 1 2006 . However, Jaipur Rental reserves the right to change its Fee Charging and Credit policies from time to time. In particular, Rent bazaar may at its sole discretion introduce new services and modify some or all of the existing services offered on the Site. In such an event Jaipur Rental reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Charging and Credit policies shall be posted on the Site and such changes shall automatically become effective immediately after they are posted on the Site.

Unless otherwise stated, all fees shall be quoted in Indian Rupees. You are responsible for paying all fees associated with the use of the Site and you agree to bear any and all applicable taxes, charges, cesses etc. levied thereon. Jaipur Rental reserves the right to issue a warning, temporarily /indefinitely suspend or terminate your membership and refuse to provide you with access to the Site in case of non-payment of fees by you to Jaipur Rental. Jaipur Rental also reserves the right to take legal action in case of non-payment of fees by you to Jaipur Rental

Payment Of Listing Fees

Payments of LISTING FEES on the Site can be made through the online payment facility provided called www.CCAvenue.com from AVENUES (INDIA) PVT. LTD .,. At present AVENUES (INDIA) PVT. LTD., supports Credit Card Payments [ & ] and Online Bank Transfers. Currently Online Bank Transfers can be done through the Internet banking services of several leading banks, including ICICI Bank Ltd., HDFC Bank, Citibank, UTI Bank, IDBI Bank, Centurion Bank and various other banks
By using AVENUES (INDIA) PVT. LTD., you agree to be bound by the terms and conditions governing the use of www.CCAvenue.com. The terms and conditions of CCAvenue are available here www.CCAvenue.com
By providing an online payment facility on the Site through www.CCAvenue.com. Jaipur Rental is merely facilitating the making of online payments by RENTOR and Jaipur Rental is not involved in the process of renting of items on the Site. All rental services on the Site continue to be bipartite contracts and Jaipur Rental is not responsible for any non-performance or breach of any contract entered into between the Rentee and Rentor /the service provider. Jaipur Rental is merely a platform for communication as set out in the section above.

In case the fees are being paid through cheques the same should be drawn in favour of Reliquus Ventures payable at Pune. The cheques can be deposited in any ICICI BANK ATMs / or sending the cheque by post courier or in person the the registered office of Reliquus ventures.

Membership/S
When you register as a Jaipur Rental member, you accept the following terms and conditions:

1. You agree to provide true, accurate, current and complete information as required in the registration form.
2. You agree maintain and promptly update the Registration Data as necessary to keep it true, accurate, current and complete.

If, after investigation, Jaipur Rental has reasonable grounds to suspect that any user's information is untrue, inaccurate, not current or incomplete, Jaipur Rental may suspend or terminate that user's account and prohibit any and all current or future use of the Jaipur Rental Sites (or any portion thereof) by that user other than as expressly provided herein.

Each user is wholly responsible for maintaining the confidentiality of account login and password information and for all activities occurring there under. Jaipur Rental cannot and will not be liable for any loss or damage arising from a user's failure to comply with this, including any loss or damage arising from any user's failure to:

1. immediately notify Jaipur Rental of any unauthorized use of his or her password or account or any other breach of security; and
2. ensure that he or she exits from his or her account at the end of each session.

Cancellation
Jaipur Rental shall reserve the exclusive right to cancel any content whatsoever from being published or reflected on its website or in any other mode.

Intellectual Property Rights
All logos, brands, trade marks and service marks ("Marks") appearing in Jaipur Rental are the properties either owned or used under license by Jaipur Rental and / or its associates. All rights accruing from the same, statutory or otherwise, wholly vest with Jaipur Rental / its Associates. The access to this Website does not confer upon you any license or right to use in respect of these Marks and therefore the use of these Marks in any form or manner, whatsoever is strictly prohibited. Any violation of the above would constitute an offence under the prevailing laws of India.

Jaipur Rental respects the Intellectual Property Rights of all, it has and will continue to adhere to all the laws applicable in India in this respect. Jaipur Rental shall protect and respect the Intellectual Property Rights of the users as well as third parties to the best of its ability. In a case where a user/users are found to be using Jaipur Rental as a platform to infringe the Intellectual Property Rights of others, Jaipur Rental will be free to terminate this agreement forthwith without any notice to the user.

Breach
Without limiting other remedies, Jaipur Rental may limit your activity, immediately remove your bids, or end your listing, warn other Users of your actions, immediately temporarily/indefinitely suspend or terminate your membership, and/or refuse to provide you with access to the Site:

• If you breach the User Agreement or the documents it incorporates by reference;
• If Jaipur Rental is unable to verify or authenticate any information you provide; or
• If it is believed that your actions may cause legal liability for you, other Users or Jaipur Rental.

Jaipur Rental may at any time at its sole discretion reinstate suspended Users. A User that has been indefinitely suspended may not register or attempt to register with Jaipur Rental or use the Site in any manner whatsoever until such time that such User is reinstated by Jaipur Rental. Notwithstanding the foregoing, if you breach the User Agreement or the documents it incorporates by reference, Jaipur Rental reserves the right to recover any amounts due and owing by you to Jaipur Rental and to take strict legal action including but not limited to a referral to the Cyber Crime Division / initiating criminal proceedings against you.

No Warranty
Jaipur Rental and its suppliers provide the Site and services "as is" and without any Warranty or condition, express, implied or statutory and specifically disclaim any implied Warranties of title, merchantability, fitness for a particular purpose and non-infringement. You expressly agree that your use of the Site is at your sole risk.

Limitation Of Liability
In no event shall Jaipur Rental or its suppliers be liable for any direct, indirect, incidental, special, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Site, its services or this agreement (however arising, including negligence).

Jaipur Rental 's liability in any circumstance is limited to the amount of listing fees, if any, paid by you to Jaipur Rental. Jaipur Rental, its associates and technology partners make no representations or Warranties about the accuracy, reliability, completeness, currentness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Site or that the operation of the Site will be error free and/or uninterrupted. Consequently, Jaipur Rental assumes no liability whatsoever for any monetary or other damage suffered by you on account of:

The delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Site; and/or

Any interruption or errors in the operation of the Site. You expressly understand and agree that Jaipur Rental shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Jaipur Rental has been advised of the possibility of such damages).

Indemnity
You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of the User Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
GOVERNING LAW
By accessing the Website you agree that the laws prevailing in India shall be the governing laws in all matters relating to Jaipur Rental as well as these Terms and Conditions.

JURISDICTION
Courts at Pune, India alone shall have the exclusive jurisdiction in all matters relating to Jaipur Rental and these Terms and Conditions, irrespective of the territory and jurisdiction of your access to Jaipur Rental.

Jaipur Rental does not routinely monitor your postings to the web site but reserves the right to do so. However, if Jaipur Rental becomes aware of an inappropriate use of Jaipur Rental or any of its Services, Jaipur Rental will respond in any way that, in its sole discretion, Jaipur Rental deems appropriate. You acknowledge that Jaipur Rental will have the right to report to law enforcement authorities any actions that may be considered illegal, as well as any information it receives of such illegal conduct. When requested, Jaipur Rental will co-operate fully with law enforcement agencies in any investigation of alleged illegal activity on the Internet.

Arbitration
If any dispute arises between you and Jaipur Rental during your use of the Site or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the User Agreement, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by Jaipur Rental. The place of arbitration shall be Pune. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language

Acknowledgment And Acceptance Of Terms And Conditions
The terms and conditions appearing here above consists of the entire agreement between the Party/User (as defined above ) and Jaipur Rental (as defined above ) and replaces all previous arrangements/schedules between the parties regarding the subject matter contained herein above. It is to be noted Jaipur Rental may change these terms and conditions and its privacy policy from time to time. The User is required to check these regularly. The User’s use of website www.rentalneed.com will be deemed to be an acceptance of the changed terms- conditions and privacy policy existing at that point of time.
By completing the registration process and/or checking the “I have read and accept the” Terms of Use” box, you are indicating your acceptance to the agreement and to be bound by all of the terms and conditions of Jaipur Rental as appearing hereinabove.
